These Terms of Service (hereinafter referred to as "Terms") govern your access to and use of the website sfashionwide.com (the "Site") operated by sfashionwide.com ("NEXCART", "we", "us", or "our"). By accessing or using the Site, making a purchase, or creating an account, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site. NEXCART sells clothing and accessories primarily to customers in Europe but accepts global orders. All transactions are processed in Euros (EUR).

Prices for all products are listed in Euros (EUR) and exclude shipping fees unless otherwise stated. Shipping fees are calculated at checkout and added to your total. 14. Force Majeure

NEXCART shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from events beyond our reasonable control, including but not limited to acts of God, war, civil unrest, terrorism, natural disasters, pandemics, strikes, supply chain disruptions, government actions, or technical failures.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Kentucky, United States, without regard to its conflict of law principles. For customers located in the European Union, mandatory consumer protection laws of your country of residence may apply in addition to or instead of Kentucky law.

Any dispute arising from these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiations. If the dispute cannot be resolved within 30 days, either party may submit the dispute to binding arbitration in Lexington, Kentucky, in accordance with the rules of the American Arbitration Association, unless applicable law requires otherwise. For EU customers, you may also have the right to use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

17. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.

18. Entire Agreement

These Terms, together with our Shipping Policy, Return and Refund Policy, Privacy Policy, and any other legal notices published on the Site, constitute the entire agreement between you and NEXCART regarding your use of the Site and your purchases.
